Conditional Offer of Fixed Penalty

Q Do you need my driving licence or licence details? 

We do not need your actual Driving Licence.  To comply with the Conditional Offer of Fixed Penalty you will need to make payment and only submit your Licence details on the forms provided.

Q I can't find my driving licence, what do I do now?

• You must submit your licence details (not your actual licence) to comply with the Conditional Offer of Fixed Penalty. Therefore, if you have a record of your licence details you can carry on and accept the Fixed Penalty.  If you have lost your licence you should apply for a new licence immediately.  You can apply online at http://www.direct.gov.uk by clicking in the ‘motoring’ link or by obtaining a D1 form from a Post Office. If you have not received a new licence from DVLA within 14 days of submitting a request you should contact them immediately.
  
  
• You have 28 days from the date of service of the Conditional Offer of Fixed Penalty to accept the fixed penalty, any delay in applying for a new Driving Licence may jeopardise your opportunity to resolve the matter via the conditional offer and you may be referred to the court instead.

Q Can I pay the conditional offer of fixed penalty by way of instalments? 

• No, your payment must be for the full fixed penalty amount stated on your notice, unfortunately there are no facilities to pay by way of instalments.  Please note underpayments will not be accepted and overpayments will lead to a delay in processing your fixed penalty which risks the matter being referred to the Magistrates Court.

Q Can I comply with the conditional offer of fixed penalty online?

• Yes, you can comply online at https://penaltynotice.homeoffice.gov.uk/

Q Can I have a higher fine and no penalty points?

• No, if you receive a Conditional Offer of Fixed Penalty the fine is set by the Government and is not negotiable, the current penalty points and a fine amount will be stated on your notice.

Q What happens if I want the magistrates court to decide my fine? 

• If you are found guilty of the offence the Magistrates Court will consider your financial circumstances and that of the offence to determine the penalty amount you will be ordered to pay this will also include a victim surcharge.  The Magistrates court will also determine the number of penalty points you will receive if convicted.

Q I already have points on my licence, what will happen to me next?

• If you have 8 or less current penalty points on your Driving Licence you are able to accept the Conditional Offer of Fixed Penalty.
• If you have 9 or more current penalty points you may be liable for disqualification and the matter may be referred to the Magistrates Court.

Q I'm a new driver, will I lose my licence?

• If you reach 6 or more penalty points within 2 years of passing your test the DVLA will automatically revoke your licence once notified by HMCTS North Fixed Penalties.
